General Terms and Conditions (GTC)
Introduction
These General Terms and Conditions (hereinafter: "GTC") contain the contractual terms and conditions between besco exim ltd from now on "Besco Kft." (hereinafter: "Service Provider," "We," "Us") and the buyer or user of the goods or services (hereinafter: "Consumer," "Buyer," "You").
The Service Provider reserves the right to modify the GTC at any time and will publish the changes on the website. The modified GTC will become effective after publication.

Subject of the Contract
The subject of the contract is the sale of goods and services offered by the Service Provider on the Website (or in another format), with which the Buyer enters into a contract by placing an order with the Service Provider.

Formation of the Contract
The contract is concluded upon receipt of the Buyer’s order and the Service Provider’s confirmation. By placing an order, the Buyer automatically accepts these GTC. The Service Provider will confirm the Buyer’s order by sending a confirmation to the provided email address.
 
Ordering and Purchase
By ordering products or services, the Buyer accepts these GTC and commits to paying the purchase price for the ordered goods or services.
The purchase process is as follows: The Buyer selects the product or service, adds it to the shopping cart, and then reviews the order details before finalizing the purchase.
After finalizing the order, the Buyer is obliged to pay the purchase price in the manner specified by the Service Provider (e.g., bank transfer, online card payment, cash on delivery).

Prices and Payment Terms
The prices listed on the Website are gross prices, meaning they include the legal value-added tax (VAT).
The Buyer can choose the payment method (bank transfer, online credit card payment, cash on delivery, etc.) when finalizing the order.
The Service Provider reserves the right to correct any pricing errors that may appear on the website during the order processing. The Buyer will be promptly notified of such corrections.

Shipping Terms
The products will be shipped to the delivery address provided by the Buyer.
The Service Provider will arrange the shipping with the carrier selected by the Buyer and will inform the Buyer of the shipping cost before the order is finalized.
The delivery time may vary depending on the type of product and the delivery address. The exact delivery time will be determined based on the shipping address provided by the Buyer.
Prices, Payment Method, Payment
-The Seller reserves the right to change the prices.
- The Buyer can purchase the product listed on the order form at the prices valid at the time the order is submitted.
- The prices displayed on the website include VAT, but do not include delivery charges, which will be communicated to the Buyer upon order receipt.
- In the case of online purchases, the payment method for the products is online (credit card) payment.
Limitation of Liability
- The Seller is not liable for any direct or indirect damages arising from the use of the website, including damages caused by computer viruses or so-called "spam."
- The Seller is not responsible for the following circumstances, facts, or events, regardless of the reason for their occurrence or outcome:

  • Any data sent and/or received on the internet that does not originate from the Seller.

  • Any operational errors in the internet network that prevent the website from functioning properly or hinder the purchase process.

  • Any malfunction in any receiving device used in the communication line.

  • Any data loss.

  • Any malfunction in the software used in the process.

  • Any program error, extraordinary event, or technical failure in the service provider's network.

  • The images, videos, and descriptions on our website are protected by copyright; any partner may use them for redistribution at their own risk. We assume no material or moral responsibility for sharing content (such as images, descriptions, videos, links, etc.).

Under certain circumstances, copyrighted works can be used without violating copyright laws:
If the copyright holder has been contacted and has granted permission to use the content. It is advisable to request written permission, such as through a licensing agreement.
Some copyright holders make their works available without compensation, subject to a few requirements.

Complaint Handling, Legal Disputes
The Buyer can submit complaints related to their purchase via the contact details specified under the "Withdrawal" section. The complaint handling process is free of charge for the Buyer.
The Seller will examine any verbal complaints without delay and, if possible, offer an immediate solution. If the Buyer disagrees with the complaint handling or if immediate resolution is not possible, the Seller will record the complaint in a protocol, which the Buyer can supplement with remarks and sign. The Seller will investigate the complaint and inform the Buyer of their position in writing within 5 business days. A protocol will be immediately drawn up for any complaints communicated by phone.

Right of Withdrawal
- The Buyer has the right to withdraw from the contract within 14 (fourteen) days from the receipt of the goods without providing any reason. The withdrawal period expires 14 days after the day on which the Buyer receives the ordered product. The Buyer may exercise the right of withdrawal at any time between the conclusion of the contract and the receipt of the product, without providing any justification. The Buyer may exercise their right of withdrawal within the specified period by sending a clear written statement to the Seller or by completing and sending the withdrawal form included as an annex to these GTC, using the following contact details: Besco Kft. (Postal address: 6070 Izsák, Rákóczi Street 21. Email: kft.besco@mail.com). The Buyer will be considered to have exercised the right of withdrawal within the period if they send the withdrawal statement to the Seller before the expiration of the withdrawal period.
- In the case of a legal withdrawal as described above, the Seller will refund the purchase price paid by the Buyer by bank transfer no later than 14 (fourteen) days from the receipt of the withdrawal notice.
- The Buyer is obligated to return the product affected by the withdrawal, at their own expense, without delay, and no later than 14 (fourteen) days after submitting the withdrawal notice. The Seller may withhold the purchase price until the product is returned.
- In the event of withdrawal, the Buyer bears the costs related to returning the product to the Seller.
- The Seller declares that it does not have a code of conduct according to Act XLVII of 2008 on the prohibition of unfair commercial practices towards consumers.
- The Buyer may not exercise the right of withdrawal in the following cases, as specified in Section 29 of Government Decree 45/2014 (II. 26.):

  • a) in the case of a service contract, after the service has been fully performed, if the business started the performance with the explicit, prior consent of the consumer and the consumer was informed that they would lose their right of withdrawal after the full performance of the service;

  • b) for a product or service whose price or fee depends on fluctuations in the financial market beyond the control of the business;

  • c) for a product that is made to the consumer's specification or clearly personalized;

  • d) for perishable goods or products with a short shelf life;

  • e) for sealed products that cannot be returned for health or hygiene reasons once opened after delivery;

  • f) for products that, by their nature, become inseparably mixed with other items after delivery;

  • g) for alcoholic beverages, whose actual value is dependent on market fluctuations outside the control of the business, and which the parties agreed upon at the time of the contract, but the delivery occurs after 30 days from the conclusion of the contract;

  • h) for a contract in which the business, at the consumer's explicit request, visits the consumer for urgent repairs or maintenance;

  • i) for sealed audio or video recordings and computer software, if the consumer has opened the packaging after delivery;

  • j) for newspapers, periodicals, and magazines, except for subscription contracts;

  • k) for contracts concluded at public auctions;

  • l) for accommodation contracts (except for residential purposes), transportation, car rental, catering, or leisure services, where a specific performance date or deadline was stipulated;

  • m) for digital content provided on a non-tangible medium, if the business began performance with the consumer's explicit, prior consent and the consumer was informed that they would lose their right of withdrawal once performance had begun.

- If the product is defective and the Seller delivered a non-functioning product to the Buyer, and the Buyer exercises their warranty claim within three days from receipt of the product and requests a replacement, the Seller will replace the product.

. Warranty and Guarantee, Liability for Defects
Liability for Defects 
In which cases can you exercise your right to liability for defects?
You may exercise your liability for defects claim against Besco Kft. in the case of defective performance by the company, in accordance with the provisions of the Civil Code.
What rights do you have based on your liability for defects claim?
You may request either repair or replacement of the product, unless it is impossible to fulfill the claim you have selected or if fulfilling the claim would result in disproportionate additional costs for the business. If you do not request or cannot request repair or replacement, you may demand a proportionate reduction in the price or, at your expense, you may repair the defect yourself or have it repaired by someone else. Alternatively, in the final case, you may withdraw from the contract.
You may switch to another liability for defects right, but the cost of the switch is borne by you, unless the switch was justified or prompted by the business.
In which time period can you exercise your liability for defects claim?
You must inform the business about the defect without delay, but no later than within two months from discovering the defect. However, please note that you can no longer exercise your liability for defects rights after the two-year limitation period from the performance of the contract. For used goods, this period is six months.
Against whom can you exercise your liability for defects claim?
You can exercise your liability for defects claim against the business.
What other conditions must be met for the exercise of your liability for defects rights?
Within six months from the performance, there are no other conditions for the enforcement of your liability for defects claim beyond notifying the business of the defect, provided that you prove that the product or service was provided by Besco Kft. After six months from the performance, however, you must prove that the defect existed at the time of performance.
 
Product Warranty 
In which cases can you exercise your right to product warranty?
In the case of a defect in a movable item (product), you may, at your discretion, exercise either the right under point 1 (liability for defects) or the product warranty claim.
What rights do you have based on your product warranty claim?
Under a product warranty claim, you may only request repair or replacement of the defective product.
When is a product considered defective?
A product is defective if it does not meet the quality requirements in force at the time of its introduction to the market or if it does not possess the properties specified by the manufacturer in its description.
In which time period can you exercise your product warranty claim?
You may exercise your product warranty claim within two years from the product being placed on the market by the manufacturer. After this period, you lose your right to claim product warranty.
Against whom and under what other conditions can you exercise your product warranty claim?
You may only exercise your product warranty claim against the manufacturer or distributor of the product. In the case of a product warranty claim, you must prove the defect in the product.
In which cases is the manufacturer (distributor) exempt from their product warranty obligation?
The manufacturer (distributor) is exempt from their product warranty obligation if they can prove that:

  • The product was not manufactured or marketed within the scope of their business activities, or

  • The defect was not detectable at the time of market introduction according to the state of science and technology, or

  • The product's defect arises from the application of law or mandatory regulatory requirements.
    It is sufficient for the manufacturer (distributor) to prove one of these reasons to be exempt from the product warranty.

Please note that you cannot exercise both a liability for defects claim and a product warranty claim at the same time for the same defect. However, if your product warranty claim is successful, you can still exercise your liability for defects claim regarding the replacement or repaired part of the product.
 
Guarantee
In which cases can you exercise your right under the guarantee?
In case of defective performance, Besco Kft. is obligated to provide a guarantee under the contract.
What rights do you have and within what time period under the guarantee?
The rights under the guarantee depend on the type of product and the guarantee period provided by the business.
When is the business exempt from the guarantee obligation?
The business is only exempt from the guarantee obligation if it can prove that the defect occurred after the performance.
Please note that you cannot exercise both a liability for defects claim and a guarantee claim, or a product warranty and a guarantee claim at the same time for the same defect. 

Limitation of Liability
1. The Service Provider is not responsible for any indirect, incidental, or consequential damages resulting from the use of the Website or the ordered products.
The Service Provider is not liable for issues arising from incorrect data provided by the Customer, such as delays in delivery.

2. Product Use and Safety
Our products are intended for use according to the manufacturer's instructions and guidelines. Besco exim Ltd. is not responsible for any injuries, damages, or losses resulting from improper use, handling, or maintenance of our products. By purchasing and using our products, you agree to use them in a manner that complies with all applicable laws, safety guidelines, and regulations.

3. Product Availability and Accuracy
While we strive to provide accurate and up-to-date information on our website, [Your Store Name] makes no representations or warranties about the accuracy, completeness, or reliability of the content, pricing, or product information provided. We reserve the right to modify or discontinue products, prices, or services at any time without prior notice.

4. Force Majeure
Besco exim Ltd. shall not be liable for any delay or failure to fulfill its obligations under this agreement caused by events beyond our reasonable control, including but not limited to acts of nature, government restrictions, natural disasters, terrorism, war, labor disputes, or any other event that is outside of our reasonable control.

5. Maximum Liability
In no event shall Besco exim Ltd. total liability to you for all damages, losses, or causes of action exceed the amount paid by you, if any, for purchasing the product(s) or service(s) that gave rise to the claim.

6. Third-Party Links and Content
Our website may contain links to third-party websites or content. We do not control, endorse, or assume responsibility for the accuracy, legality, or content of any third-party websites or services. By accessing third-party sites, you agree to do so at your own risk, and Besco exim Ltd. shall not be held liable for any damages or losses resulting from your use of third-party websites or services.


- Processing of Personal Data
The Service Provider handles the Customer’s personal data in accordance with the Privacy Policy, which is available on the Website. In processing personal data, the Service Provider complies with all legal requirements and ensures their secure handling.
- Modification of the Contract
The Service Provider reserves the right to modify these General Terms and Conditions (GTC) at any time. Changes will apply to new contracts after they are published on the Website. Contracts concluded before the changes will be governed by the previous terms and conditions.
- Legal Remedies
The Customer may enforce their rights by turning to the courts. If the Customer wishes to settle a dispute with the Service Provider, they may proceed before the competent court or the consumer arbitration board.

Applicable Law
The laws of Hungary apply to these General Terms and Conditions and the contractual relationship between the parties.
Other Provisions:
The Seller's activity concerning the trade of firearms and ammunition is subject to legal regulations.
In matters not regulated in these GTC, as well as in the parties' legal relationship, the Civil Code, Act CVIII of 2001 on Electronic Commerce Services, Government Decree 45/2014 (II. 26.) on the detailed provisions of contracts between consumers and businesses, and the applicable consumer protection regulations shall apply.

2. Eligibility to Purchase Ammunition

By purchasing ammunition from our website, you confirm that you:

  • Are at least 18 years of age.

  • Hold a valid and appropriate Hungarian firearms license or other lawful authorization under Hungarian law.

  • Will use the purchased ammunition in compliance with all applicable laws and regulations, including but not limited to Act XXIV of 2004 on Firearms and Ammunition and relevant EU directives.

3. In-Store Pickup Requirement

Ammunition purchased online cannot be shipped.

All ammunition orders must be picked up in person at our licensed premises:

At the time of pickup, the customer must present:

  • A valid firearms license corresponding to the type of ammunition purchased.

  • A valid photo ID (e.g. personal identification card or passport).

Failure to present valid documentation will result in refusal to hand over the product. No exceptions will be made.

4. Order Cancellation and Refund Policy

You may cancel your order for ammunition prior to pickup. However:

  • Refunds will only be issued to the original payment method.

  • Once the ammunition has been picked up and the transfer logged, no returns or refunds are allowed due to legal restrictions.

5. Legal Responsibility

By placing an order, you acknowledge and agree that:

  • You are legally permitted to possess and purchase the ammunition.

  • It is your responsibility to know and follow all applicable firearm and ammunition laws in Hungary and the EU.

  • We are not responsible for misuse, unlawful possession, or any legal consequences arising from the use or possession of purchased items.

We reserve the right to cancel any order at our discretion if we suspect misuse, fraudulent activity, or legal non-compliance.
